Terms and Conditions of Sale

  • User: any person who browses, purchases, or uses the services offered on the Site
  • Products: clothing and accessories sold on the Site
  • Terms: these conditions governing the sale

2. Acceptance of Terms

    2.1. By placing an order, the User unconditionally accepts these Terms.
    2.2. The Owner reserves the right to modify these terms at any time; the terms in effect at the time of purchase will apply.

3. Orders and Contract Conclusion

    3.1. Orders may only be placed by users who are of legal age. In the case of a purchase by a minor, it is presumed that a parent or legal guardian has supervised or authorized the transaction and will be held responsible.
    3.2. Products are presented with images as accurately as possible; however, slight variations in color or proportions may occur due to photographic lighting or device display differences.
    3.3. The contract is considered concluded only after order confirmation via email.
    3.4. The Owner reserves the right to reject an order at its discretion (e.g., in the case of irregularities, suspected fraud, or product unavailability).

4. Prices and Payments

    4.1. All prices are expressed in Euros and do not include VAT, as the Owner adheres to the flat-rate tax regime.
    4.2. Shipping costs are calculated during checkout and vary depending on the destination country.
    4.3. Payments are accepted through the methods indicated on the Site (e.g., credit card, PayPal, etc.).
    4.4. The Owner is not responsible for delays or failed transactions due to payment systems.

5. Shipping

    5.1. Shipping times and costs vary depending on the destination and are clearly indicated during the checkout process.
    5.2. Orders are processed and shipped within 2–3 business days from order confirmation. Delivery times depend on the destination country and the shipping carrier selected at checkout.
    5.3. Delivery times are indicative and may vary due to circumstances beyond the Owner’s control (e.g., customs, strikes, holidays, weather conditions).
    5.4. The Owner is not responsible for any customs duties or taxes applied in non-EU countries.

6. Returns

    6.1. The User has the right to withdraw from the purchase within 14 days of receiving the product, as provided by Legislative Decree 206/2005.
    6.2. To request a return, an email must be sent to info@phunkiclothing.com with the order details.
    6.3. Products must be returned intact, unused, unwashed, undamaged, and in their original packaging, with all labels still attached.
    6.4. After verifying the integrity of the returned products, a refund will be issued using the same payment method used for the purchase, within 14 days of receiving the return.
    6.5. Returns will not be accepted for products that are damaged, used, washed, or altered.
    6.6. Return procedures and shipping costs will be communicated via email at the time of the request.

7. Exchanges

Exchanges are not currently offered.
If you would like a different size or item, please place a new order after
returning the purchased product.

8. Limitation of Liability

    8.1. The Owner is not responsible for minor color or size differences due to:
  • display differences across devices
  • individual perception differences
  • improper washing
  • normal product wear and tear
    8.2. Users are encouraged to read product descriptions carefully before purchasing.

9. Intellectual Property

    9.1. All content on the Site (texts, images, logos, design, trademarks) is the exclusive property of the Owner and protected by applicable copyright and industrial property laws.
    9.2. Any reproduction, even partial, is prohibited without the Owner’s written authorization.

11. Applicable Law and Jurisdiction

    11.1. The contract is governed by Italian law.
    11.2. In the event of disputes, the competent court is that of the consumer’s place of residence or domicile, if located within the State.
